Brain injury may result from trauma in an accident, lack of oxygen during surgery, a mishandled labor and delivery, or a wide variety of causes.  A victim may suffer a scull fracture in an accident, but most cases of brain injury are much more subtle and the injury may be difficult to detect and prove.  Often the first sign of brain injury is an unexplained change in personality after a trauma or medical treatment.

Brain injury may be global, rather than a visible lesion that can be seen on a CT or MRI film.  In such cases the injury can only be proven through neuropsychological testing specifically designed to pick up brain damage.
